This Policy explains how we collect, use, transfer, preserve, secure, and disclose personal data provided by customers or end users in connection with their use of the qcoom Cloud Platform and/or our Cloud Services, as well as other data-related terms. It also explains our (customer's) options for using, accessing, and correcting their personal data. Our qcoom.com services are designed for business organizations. If a customer registers an account and purchases or uses qcoom.com using his or her organization's email address, the owner of the domain associated with the customer's email address, and/or his or her organization, may monitor or control his or her account with the qcoom Platform and access, process, and/or control his or her personal data, as well as the contents of his or her communications and files. We are not responsible for their organization's privacy or security practices. We don't have any direct contact with end users and/or customers. Customers/end users should direct all privacy inquiries, such as requests to view, update, revise, or delete personal data, to this location. We are not responsible for our clients' privacy or security activities.
COLLECTION OF DATA
Data means personal data. Data or information of a customer is most important for online ecommerce business, and we must store these data/information with safety and security. Our aim is to provide the customer/user safe, efficient, smooth and customized know-how, which allows us to provide services and features that likely run into their needs, and to modify our website that make their experience safer and easier. To verify the identity of a customer or end user, we record his/her communication information/data for customer services purposes, as well as collect additional information during customer support service, sales or others. We collect, retain, use and disclose personal data for the following purposes: Processing the registration as a user, providing them with a user ID for our qcoom Cloud platform and maintaining and managing your registration; Providing them with customer service and responding to their queries, feedback, claims or disputes; Personalizing our communication with them based on their order history, and performing research or statistical analysis in order to improve our product offerings and services; to comply with applicable law, legal process or lawful government request, or in respect of any claims or potential claims brought against us or our parent companies, shareholders, subsidiaries and affiliates; performing risk control, legal compliance and sanctions screening; performing screening and checks for unlawful, fraudulent, deceptive or malicious activities; and Subject to obtaining specific consent (or where otherwise permitted by applicable law in jurisdiction), we may use name, phone number, residential address, email address and fax number (which may incorporate personal data) to provide notices, surveys, product alerts, related communications and other marketing and promotional materials to them relating to goods and services offered by us on our qcoom Platform.
DISCLOSURE OF PERSONAL DATA
We may disclose personal data/information of our customer to “Third Party Service Providers” engaged by us to assist them to provide services, to contact with them regarding promotional activities and services, performing risk control, fraud prevention and legal compliance procedures, and conducting payment processing services. We may share your personal data with affiliated companies in the qcoom Group and/or their designated Service Providers, for the purposes specified at Section B above. We may provide aggregated or anonymized data to third parties, but when we do so, the information we share is in a de-identified format that does not personally identify the customer. SECURITY OF PERSONAL DATA/INFORMATION The qcoom.com use commercially reasonable endeavors to protect the personal data/information that a customer provide. Nevertheless, no data transmission over the internet or any wireless network can be guaranteed to be perfectly secure. The qcoom.com cannot guarantee the security of any personal data transmitted to us by the customer and do so at their own risk. The qcoom.com cannot and do not guarantee security in connection with use of the qcoom Cloud Platform and Cloud Services. We retain personal data as long as a customer has an account with us, as needed to provide services or products to the customer, to resolve disputes, to serve the purpose of research and statistical analysis or as required or permitted by applicable laws, such as tax and accounting laws. RIGHT TO ACCESS PERSONAL DATA Customers have right to request access to their personal data and to request correction or deletion of such personal data. Additionally, upon request, qcoom.com will provide customers with information about whether we hold their personal data. Customers may contact us at support@qcoom.com to request access, correction or deletion of personal data. We will respond to their request within a reasonable timeframe. In cases, where we act as a processor, we have no direct relationship with the individuals whose personal data we process. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to qcoom Cloud’s client (the data controller). Customers may receive e-newsletters from us. If the customer would like to discontinue receiving this information, they may update their email preferences by using the “Unsubscribe” link found in emails we send to them or at their member profile. We do not knowingly collect personal data of minors (persons under the age of 18). If a minor has provided personal data, the parent or guardian may contact us on the minor’s behalf to request that we cease any further collection, use and/or disclosure of the personal data and delete the personal data we may hold relating to the relevant minor. Eligibility
Use of the Website is available only to such persons who can legally contract under the Contract Act, 1872. The usage of the Services offered through the Website is only available if the address of the User to which the product(s) is/are to be delivered is within Dhaka City, Bangladesh; qcoom is serving with 1 Hour Delivery Service, to Uttara, Mirpur, Cantonment, Banani, Banani DOHS, Gulshan, Baridhara, Baridhara DOHS, Badda, Mohakhali, Mohakhali DOHS, Khilgaon, Paltan, Motijheel, Banasree, Moghbazar, Malibag, Razarbag, Kallyanpur, Shyamoli, Paikpara, Pallabi and Mohammedpur. For the rest of the Dhaka city qcoom is currently delivering within 4-7 hours timeframe. Subject to the above, if the User specifies a convenient time and qcoom will send the products during that time. Communication When you use qcoom.com, or contact us via phone or email, you consent to receive communication from us. You authorize us to communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to your use of the website and/or your order placed on the Website. Additionally any disclosures posted on the site, or sent to you by email fulfill the legal obligation of communication made in writing.
Your Account and Responsibilities
1.Any person may access the Website either by registering to the Website or using the Website as a guest. Charges
Membership on the website is free for users. qcoom does not charge any fee for browsing and buying on the website. qcoom reserves the right to change its fee policy from time to time. In particular, qcoom may at its sole discretion introduce new services and modify some or all of the existing services offered on the website. In such an event, qcoom reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the fee policy will be posted on the website and such changes will automatically become effective immediately after they are posted on the website.

Any repetitive or suspicious or abusive practice during any offer or promotion might result as cancelled order & qcoom reserves the right to do so to protect the rigths & beniits of other users. Account that tends to abuse any offer by any means on the platform can also get termniated to maintain hygiene factor on the platform. The automated abuse detecction technology that qcoom has can be also enforced at anytime without any sort of prior notice. Discount code(s) offered to any/all segment of customer(s) through different marketing channels might get disabled or extended by the authority at anytime without any prior notice. The Contract
Your order is an offer to us to buy the product(s) in your order. When you place an order to purchase a product from us, you will receive an e-mail and/or SMS to your mobile phone number confirming receipt of your order and/or containing the details of your order (the "Order Confirmation E-mail and/or SMS"). The Order Confirmation E-mail and/or SMS is acknowledgement that we have received your order, but does not confirm acceptance of your offer to buy the product(s) ordered; that when we send the Order Confirmation E-mail and/or SMS a contract called an “agreement to sell” is concluded in accordance with Section 4(3) of the Sale of Goods Act, 1930 i.e. the transfer of the property in the goods is to take place at a future time when the product(s) is/are delivered to your designated address. We only accept your offer, and the above “agreement to sell” becomes a contract of sale for product(s) ordered by you in accordance with Section 4(4) of the Sale of Goods Act, 1930, when the product(s) is/are delivered to your designated address and at that time the property in the goods is transferred from us to you. You can cancel your order for a product at no cost any time before the goods are delivered to you. Please note that we sell products only in quantities which correspond to the typical needs of an average household. Product Descriptions
qcoom attempts to be as accurate as possible. qcoom does not manufacture or produce any product by themselves. Therefore, qcoom does not warrant that product descriptions or other content of any qcoom product is accurate, complete, reliable, current, or error-free. If a product offered by qcoom itself is not as described, your sole remedy is to return it in unused condition.
Pricing
Except where noted otherwise, the list price or suggested price displayed for products on qcoom represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The list price or suggested price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. Despite our best efforts, a small number of the items in our catalog may be mispriced. If the MRP of an item sold by qcoom is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. And if the stated price on the product is lower than qcoom, we will, either refund the amount or replace the product according to your preference, when acknowledged.
Delivery Areas
You are aware that our Vendors sell their products in specific delivery areas, and that our Vendors differ from one delivery area to the next. You can see the Vendors that we make available to you at that moment by entering your delivery address on the Platforms. Weather and traffic circumstances, as well as situations of clause, may cause delivery zones to extend, diminish, or change.
Delivery Time
qcoom will deliver your order to the address that you provide. You have the option of having your Order delivered "as soon as possible" or at a certain time. Your email confirmation will include an estimated delivery time, however delivery timeframes may vary depending on circumstances beyond our control (e.g., order quantity, distance, time of day (peak periods), weather conditions, traffic conditions, and so on). When you click on 'My orders' on the Platforms, you may see the remaining delivery time for an Order. You understand that the delivery time we mention is simply an estimate, and that Orders may arrive sooner or later than expected.To ensure that you do not miss a delivery of an Order, make sure that you or someone else is present at the delivery location when the Order is placed. Foodpanda retains the right not to deliver your Order if it contains Alcohol or Tobacco (where applicable) and you or the recipient is or appears to be under the legal age, or fails to present a valid proof of ID.Unsuccessful or Failed Deliveries In cases where we attempt to deliver an Order but we are unable to do so due to the reasons caused by you, including but not limited to: 1.No one was present or available to receive the Order; or 2.Customer was uncontactable despite attempts to reach the customer via the phone number provided; or 3.Lack of appropriate or sufficient access to deliver the Order successfully; 4.Lack of a suitable or secure location to leave the Order; or 5.In the case of Restricted Goods, customer did not meet the statutory age requirements or delivery did not deem it safe or appropriate for the customer to receive the Restricted Goods. No-show Cancellations If you cannot be reached or if you do not receive the Order within ten (10) minutes of it arriving at your delivery address, qcoom reserves the right to cancel it without refund or compensation. Wrong Order, Missing Items, Defective Goods Upon receipt of your Order, if you discover that there are issues with your Order (e.g. wrong order, defective order, or missing items) please contact customer support.In some cases, qcoom may request for photographic proof and/or additional information to properly investigate the issue with your Order. If we determine that the Order and/or Goods you received are not of satisfactory condition or quality, we will compensate you for your Order or parts of your Order. Vendor Delivery In some cases, our Vendors will deliver the Order to you (“Vendor Delivery”). While we will use reasonable efforts to provide prior notice to you on Vendor Delivery, this may not always be possible. Where Vendor Delivery applies, we may ask you to contact the Vendor directly in the event of issues or delays in your delivery. qcoom shall not be responsible in any way for Orders or Goods that are delivered by Vendors. Return Policy a. A user may return any product during the time of delivery, if: Product does not meet user’s expectation. Found damaged during delivery Have doubt about the product quality and quantity Received in an unhealthy/ unexpected condition Is not satisfied with the packaging Finds product unusable We are continuously monitoring accounts of customers with excessive requests of returns and refunds. We take necessary steps to prevent this. b.A user may return any unopened or defective up to 20% and less, item within 7 days of receiving the item. But following products may not be eligible for return or replacement: 1. Damages due to misuse of product 2.Incidental damage due to malfunctioning of product 3.Any consumable item which has been used/installed 4.Products with tampered or missing serial/UPC numbers 5.Any damage/defect which are not covered under the manufacturer's warranty 6.Any product that is returned without all original packaging and accessories, including the box, manufacturer's packaging if any, and all other items originally included with the product/s delivered.
Refund Policy
qcoom tries its best to serve the users. But if under any circumstances, we fail to fulfill our commitment or to provide the service, we will notify you within 24 hours via phone/ text/ email. If the service, that qcoom fails to complete, requires any refund, it be done maximum within 7 Days after our acknowledgement. Refund requests will be processed under mentioned situation: Unable to serve with any product. Customer returns any product from a paid order. Customer cancels a paid order before it has been dispatched.For all the above three scenarios, the refund amount will be sent to qcoom Balance of the customer. And the balance can only be used to purchase at qcoom. Upon customer's request, qcoom will transfer the refund amount to the user's original payment source within 7 days. Refund is only allowed for customers who have paid via bKash or card or other electronic method. For the orders that are paid via Cash, refund is only to be given through qcoom Credits. Supply Policy: 1. qcoom, itself does not produce or manufacture any product, therefore qcoom tries to control the quality, but do not give quality assurance for any. We believe the manufacturer/ vendor/ supplier are fully capable of assuring the quality of every product. 2.If any user, at the time of receiving the order delivery, finds any product injurious to health/ life/ security, we will take full liability and will accept return of that product. If the user faces any threat after 12 hours of the provided delivery, we will consider it as a lacking within the quality assurance from the manufacturers or suppliers. 3.All products displayed on the website are subject to change and are subject to availability.
Modifications
qcoom reserves the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on qcoom.com. You are responsible for the reviewing of such modifications. Your continued access or use of qcoom.com shall be deemed your acceptance of the modified terms and conditions. qcoom Software Terms 1.Use of the qcoom Software/Application/App: You may use qcoom Software/ Application/ App solely for purposes of enabling you to use and enjoy the services as provided by qcoom, and as permitted by these Terms. You may not incorporate any portion of the qcoom Software / Application/ App into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the qcoom Software / Application/ App or otherwise assign any rights to the qcoom Software / Application/ App in whole or in part. You may not use the qcoom Software / Application/ App for any illegal purpose. We may cease providing any qcoom Software / Application/ App and we may terminate your right to use any qcoom Software / Application/ App at any time. Your rights to use the qcoom Software / Application/ App will automatically terminate without notice from us if you fail to comply with any of these Terms. All software used in any qcoom Service is the property of qcoom and/or its affiliates or its software suppliers and protected by laws of Bangladesh including but not limited to any other applicable copyright laws. 2.Use of Third-Party Services: When you use the qcoom Software / Application/ App, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of those third parties. 3.No Reverse Engineering: You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the qcoom Software / Application/ App, whether in whole or in part, or create any derivative works from or of the qcoom Software / Application/ App. 4.Updates: In order to keep the qcoom Software / Application/ App up-to-date, we may offer automatic or manual updates at any time and without notice to you. 8 Delivery, Pick-Up and Vendor Delivery
